U.S. Army Soldiers Deployed on the Streets of Samson, Alabama
March 12th, 2009
I was reading this Reuters piece about a mass shooting in Alabama when I noticed these photos:
I’m waiting for a response from the Public Affairs Office at Fort Rucker. I’ll post it below if it ever comes:

To Whom it May Concern,
My name is Kevin Flaherty. I am the editor of a news and analysis
website called Cryptogon.
I saw Reuters photos of Fort Rucker soldiers deployed on the streets of
Samson, Alabama in the wake of a mass shooting there on 10 March 2009.

I was wondering if you could direct me to the law (or other mechanism)
that authorizes the deployment of regular U.S. Army personnel along side
civilian law enforcement on non-federal property? This case does not
seem to fit any of the exceptions to the Posse Comitatus Act. Perhaps I
am mistaken. Please clarify this issue.
What were the Fort Rucker soldiers ordered to do with regard to this
shooting incident?
The Fort Rucker soldiers appeared to be carrying sidearms. Were they, in
fact, carrying sidearms? If so, what were the rules of engagement on
this mission on 10 March 2009 in Samson, Alabama?
Thank you,
Kevin Flaherty

I don’t think we should hold our breath waiting for any kind of intelligent reply. The Almighty State just does whatever it wants.

Never heard of NCIS on TV? The show is fiction. The agency is not. Based only on the photos I expect that there are military personnel or dependents among the victims. Otherwise the military is unlikely to become involved in a civil crime.

This is an absolute violation of the Constitution of the United States. Somebodys head should roll for this , if what I am reading is true. Someone in Samson needs to file a Federal Lawsuit against the United States government for a violation of the U.S. Comnstitution, and as an ex miltary combat guy…the soldfiers who complied with these orders, should be ashamed of themselves ande resign form the military. For in the worst possible way, they have violated their oath to protect and defend our Constitution. Soldiers, listen up! You must not follow these kinds of orders. The first time you do, and a civilian is killed, you will then be at war with the Citizens of the United Staes. Decide now. Are you going to kill us all or you going to defend the constitution that you swore to defend. This is not a hypothetical question. Think! What will you do if ordered to shoot an American that is defending the constitution? If you say you are going to follow orders, then you are no better than the Redcoats who killed 8 civilians in Lexington, Ma. in 1775. If your commander ordered this, contact someone who can investigeate him and prosecute him. This can NEVER happen in America. It is acts like these that can escalate into events with serious consequences. This is NOT about whether or not it was an innocent event. ITS ABOUT THE CONSTITUTION ,and whether or not you are going to protect us, the Americans you serve, from tyrannical violations of our most precious documents. Make your decision now. You may be forced to make such a decision by your own government.

Here’s your question:
“I was wondering if you could direct me to the law (or other mechanism)that authorizes the deployment of regular U.S. Army personnel along side civilian law enforcement on non-federal property?”
Here’s your answer:
“the lead article in the New York Times reported a four-year-old Bush doctrine allowing Special Forces and other armed force to pursue terrorists in any country in the world.”

This is crazy, But if you guys will notice, the only light in town is a Caution light. This is a very small town were a crazy went crazy, and shot up the town.Including a Deputy’s wife and child. The police department was in no emotional shape to investigate. Ft Rucker, was just down the Rd. It was a state emergency, they had to find the crazy guy, which turned out, he shot his self.

as much as i hate to say it,i must agree with AlGAPeach.i lived in andalusia,al.-literally a stones throw from sampson and these are very small, rural towns who can barely handle one homocide, let alone a mass murder.i can’t condone the fact that the military was there as it does violate the constitution, but i can understand.i should’nt be the one to have to explain this to all you ‘big city’ folks but life is much different in small towns like these.truth, love & joy, matt

AlGAPeach, you are soo wrong on so many levels. There are many other law enforcement agencies outside the military that could and should have responded if the local enforcement agency was not able to. This is a major violation of the Posse Comitatus Act. It is very scarey, the military is neither trained or equipped to handle domestic (i.e. those that involve fellow citizens) situations. People should have as passionate of a resposne that llill00llill had! This should never have happened, any moral soldier with a good understanding of what they took an oath to should have declined to follow these orders. All it takes is for one soldier to kill a fellow citizen on non-federal property and you have a recipe for major disaster. I cannot wait to find out who requested/authorized this military (borderline coup-like) deployment. And I hope they are prosecuted to the full extent of the law.

Quote: DanielinDC said “This is a major violation of the Posse Comitatus Act.”
I recently ran across something that said that Bush signed a an executive order that did away with the Posse Comitatus Act. It really wouldn’t surprise me since all the other treasonous acts that went on in the last administration. Here are just a few of the things that I’ve come across lately.
* Executive Order 12656: “ASSIGNMENT OF EMERGENCY PREPAREDNESS RESPONSIBILITIES”, “A national emergency is any occurrence, including natural disaster, military attack, technological emergency, or other emergency that seriously degrades or seriously threatens the national security of the United States. Policy for national security emergency preparedness shall be established by the President.” This order includes federal takeover of all local law enforcement agencies, wage and price controls, prohibits you from moving assets in or out of the United States, creates a draft, controls all travel in and out of the United States, and much more. I wouldn’t be at all surprised if this isn’t the order that has a provision that does away with the Posse Comitatus Act.
* Executive Order 13010: Directs FEMA to take control over all government agencies in time of emergency. FEMA is under control of executive branch of the government.
REX-84 is the FEMA program heres a link that discusses that. http://chicago.craigslist.org/chc/pol/1279980048.html

So, I just wanted to say that I personally know exactly what role these Soldiers took in Alabama. The sat an intersection and detered traffic. They did not stop anyone, if someone rolled through they were ordered to yell for the CIVILIAN LAW ENFORCEMENT, that was just outside of the camera angle to handle the situation. If you would like so jerk up there poking around your dead family as they lie on the front porch, taking pictures and posting them god only knows where, then by all means, you step up and volunteer YOUR services. These Soldiers risk their lives daily so that you can sit on your a$$ and complain about everything. I personally find you all disgusting, and recommend that you pack your bags and move to another country. I know for a FACT that Iraq or Afghanistan have plenty of unsettled territory for you to plop your sorry rear end.

Are you people serious? Is is not enough that the military was helping the civilian force to get to the bottom of a dispicable crime? Are we so insensitive to the nature of the crime and so childish that we have to cry about who was there assisting and in what capacity? Grow up! No one took your birthday away from you. These fine soldiers were ASSISTING! Not taking charge, conducting searches or investigations. Find something more worthy of complaining about. I gan say with 100% certainty that there was no intention of harm or wrong doing in this situation. Is this what our nation has come to? We have to worry and complain about every little thing we can dig up? Sad, this is a very sad day.
