(Uruknet) – On September 20^th, Senate Judiciary Committee Chairman Patrick Leahy (D-VT) introduced legislation — S. 3804, the Combating Online Infringement and Counterfeits Act — that seeks to give the Department of Justice the power to shut down websites anywhere in the world that are found to infringe on intellectual property rights.  This would be accomplished by ordering U.S. domain registrars and registries to stop resolving infringing sites’ domain names.  While this bill has the noble-sounding goal of preventing online piracy, handing the federal government authority over the Internet would set a troubling precedent that would imperil Internet freedom in America and across the world. (PaulWatson) – An amalgamated cybersecurity bill that lawmakers hope to pass before the end of the year includes new powers which would allow President Obama to shut down not only entire areas of the Internet, but also businesses and industries that fail to comply with government orders following the declaration of a national emergency – increasing fears that the legislation will be abused as a political tool.

The draft bill is a combination of two pieces of legislation originally crafted by Senators Lieberman and Rockefeller. One of the differences between the new bill and the original Lieberman version is that the Internet “kill switch” power has been limited to 90 days without congressional oversight, rather than the original period of four months contained in the Lieberman bill. (PaulWatson) – Two cybersecurity bills that would hand President Obama the power to shut down parts of the Internet in the event of a national emergency have now been merged into a single unified piece of legislation that Democrats will try to pass before the end of the year, with the Department of Homeland Security being given a larger role in policing the world wide web.

Under the new draft bill, which is a combination of the two versions originally crafted by Senators Joe Lieberman and Jay Rockefeller, Janet Napolitano’s DHS will be handed broader authority to determine how to handle potential cybersecurity threats. Read the rest of this entry »
