(WSWS) – Antiwar activists in Minneapolis and Chicago targeted in last week’s FBI raids for their support of nationalist movements defined by the US as “terrorist” say they have done nothing illegal and that the invasion of their homes came without warning.

Most of those raided have been served with subpoenas to appear before a grand jury in Chicago on October 12. An unknown number of activists in other states, including Michigan, North Carolina, California and Wisconsin, have been approached by the FBI for interviews, although it is not clear if additional subpoenas have been issued.

(AlterNet) – Last month, the Supreme Court exposed Americans to jail sentences of up to 15 years just for giving advice to groups the U.S. government considers untouchable. In Holder v. Humanitarian Law Project, the court ruled that the USA Patriot Act’s expanded definition of “material support” for “foreign terrorist organizations” passes Constitutional muster. The broad wording of the statute not only makes it a crime to support violent activities, but also prohibits Americans from offering “services” or “training, expert advice or assistance” to any entity designated as a terrorist group.

Providing weapons, materials or know-how that might help terrorists commit violent acts has long been a crime, but it was only with the rushed passage of the Patriot Act just weeks following the 9/11 attacks that “expert advice or assistance” was added to the definition of “material support.” Read the rest of this entry »

In a case pitting free speech against national security, … on Monday upheld a federal law that makes it a crime to provide “material support” to foreign terrorist organizations, even if the help takes the form of training for peacefully resolving conflicts.

Chief Justice John G. Roberts Jr., writing for the majority in the 6-to-3 decision, said the law’s prohibition of providing some types of intangible assistance to groups the State Department says engage in terrorism did not violate the First Amendment.

(CNN) – A divided Supreme Court has ruled the government’s power to criminalize “material support” of a terrorist organization is constitutionally permissible.

The 6-3 ruling preserves a key provision of the 2001 Patriot Act, amid claims it threatens the free-speech rights of Americans who would assist non-violent activities of certain militant and terror groups.

(CNN) – The Obama administration unveils its National Security Strategy on Thursday and it will be the first time a president explicitly recognizes the threat posed to the country by radicalized individuals at home, the president’s chief counterterrorism adviser said.

The security strategy acts as a blueprint for how a White House administration intends to protect Americans. In the past, it has focused mostly on international threats.

But a spate of terror-related plots in the United States recently prompted the Obama administration to include homegrown terrorism in the document, National Security Adviser John Brennan said Wednesday. Read entire article

Just when you thought it was safe to start expressing your right to free speech, Democrats in Congress are gearing up for a vote on a new piece of legislation to blatantly undermine the First Amendment. Known as the DISCLOSE Act (HR 5175), this bill – written by the head of the Democrats’ congressional campaign committee – is their response to the recent Supreme Court ruling in Citizens United v. Federal Election Commission. In short, the Supreme Court found that the government could not restrict the free speech rights of individuals or other entities wishing to participate in the political dialogue.

It is hard to see how establishing a level playing field for free speech – as our Founding Fathers did by making it a right under the Constitution and which the Supreme Court upheld – is a threat to our democracy. Nevertheless, the White House and their allies on Capitol Hill see honest criticism as a threat to forcing their big government, liberal agenda through Congress. So, there is no time like the present – namely five months before an election – to start putting the muzzle on those individuals and organizations not sticking to the Democrats’ talking points. (FutureofFreedomFoundation) – In an editorial yesterday entitled “Obama Administration Owes Answers on How It Handled Times Square Suspect,” the Washington Post wants to know whether the Obama administration was too hasty in treating accused Times Square terrorist Faisal Shahzad as a criminal suspect rather than an “enemy combatant.”

The Post stated:

“The administration rightly came under fire for its handling of the case of Umar Farouk Abdulmutallab, a Nigerian citizen who tried to ignite explosives on a Detroit-bound plane on Christmas Day. In that case, the Justice Department … rashly embraced a law enforcement approach without fully considering other options, including holding Mr. Abdullmutallab as an enemy combatant.” (Emphasis added.)

The Post goes on to say:

“The Shahzad case is different, primarily because Mr. Shahzad is an American citizen.”

(Yahoo) – A new bill that would permit the State Department to strip Americans of their citizenship if they support terror networks has drawn a cool reaction from the White House, even as Secretary of State Hillary Clinton appeared to embrace the measure.

“I have not heard anybody inside the administration that’s been supportive of that idea,” White House Press Secretary Robert Gibbs told reporters Thursday.

But Secretary of State Hillary Clinton said the administration would take “a hard look” at the measure, the New York Times reported. “United States citizenship is a privilege,” she told the Times. “It is not a right. People who are serving foreign powers — or in this case, foreign terrorists — are clearly in violation, in my personal opinion, of that oath which they swore when they became citizens.”

The proposed Terrorist Expatriation Act, introduced by Senate Homeland Security Committee Chairman Joe Lieberman (I-Conn.) and Sen. Scott Brown (R-Mass.), seeks to update a federal statue that outlines seven infractions that can result in Americans losing their citizenship. The measure would add to the list “actively engaging in hostilities against the United States or its allies” and “providing material support or resources” to a federally designated terrorist organization. The North Atlantic Treaty Organization was founded in April of 1949 by a country not on the European continent, the United States, and eleven subordinates which had fought on both sides of the World War that had ended four years earlier: Belgium, Britain, Canada, Denmark, France, Iceland, Italy, Luxembourg, the Netherlands, Norway and Portugal.
